The United States Court of Appeals overthrew the calculation method of tax rate adopted by the U.S. Department of Commerce in the Yangzhou Bestpak Co., Ltd’s anti-dumping case on May 20 this year. As a result, the U.S. Department of Commerce had to work out a reasonable anti-dumping tax rate according to the trade data offered by Yangzhou Bestpak Co., Ltd in the next 3 months.
Although having won the “arm-wrestling” contest with the U.S. Department of Commerce, Zhang Suoming, head of Yangzhou Bestpak Co., Ltd, still worries because the ruling power is still in the hands of the U.S. Department of Commerce.
The U.S. Department of Commerce made a final ruling of taking anti-dumping measures to narrow goods originally made in mainland China and Taiwan on July 13, 2010 -- charge a tax rate of up to 123.83 percent for Yangzhou Bestpak Co., Ltd who had enjoyed free of duty before .
After consulting a lawyer, Zhang Suoming decided to go to court with the U.S. Department of Commerce. Unexpectedly, the lawsuit lasted for 3 years and the attorney fee came up to millions of yuan. However, Zhang thought it’s worth doing. “If we win the lawsuit, the huge American market will bring development opportunities for our company,” he said.
